Five years on – Telenor complicity in Rohingyagenocide needs full independent investigation

Five years after the August 2017 genocidal operations against
Rohingya in Burma’s Arakan State, the Norwegian foreign ministry’s
OECD national contact point (NCP1) has released their final report
improperly absolving Telenor of any responsibility for what took place
at a tower that was part of Telenor’s network which was used by
soldiers to kill and wound Rohingya civilians. In the original complaint
made to the NCP, Rohingya genocide survivors described how
Government military personnel climbed the tower that is part of
Telenor’s cellular network in Alethankyaw village, south of Maungdaw,
and used it as a “vantage point to kill fleeing Rohingya men, women
and children”.

Even though the NCP admitted that Telenor is “directly linked” to what
happened at the tower, the NCP went on to absolve Telenor from
responsibility, stating: “the NCP finds that it was not reasonable to
expect Telenor to foresee [in August 2017] the misuse of
telecommunication towers by third parties for harmful purposes”.
CSJA finds this NCP position indefensible, given that beforehand,
in February 2017, the Office of the High Commissioner for Human
Rights (OHCHR) had clearly exposed the Burma Army’s systematic
atrocities against the Rohingya in their 2016 clearance operations.

Approximately one year ago ARNO wrote an open letter to Mr. Knut Osby, UN Resident and Humanitarian Coordinator in Myanmar, to stop using the derogatory term “Ku Lar” to refer to Rohingya on maps produced by the Myanmar Information Management Unit (MIMU). On April 10, 2020, the Myanmar Ministry of Foreign Affairs issued a press release, “Myanmar leaves no one behind in its fight against COVID-19 in Rakhine State,” describing its intensified efforts to raise public awareness about the virus “in Rakhine and Muslim villages and IDP camps,” and to work with the UN and INGOs to address any possible outbreak in the IDP camps.

The following complaint outlines serious breaches of OECD Guidelines for Multinational Enterprises (“the OECD Guidelines”) by Telenor and its Myanmar subsidiary, Telenor Myanmar, in relation to its activities in Myanmar’s Rakhine state. Specifically an incident in Alethankyaw, Maungdaw Township in August 2017 where a tower that is part of Telenor’s cellular network was used to aid the military as it carried out crimes against humanity against the local unarmed civilian population during a campaign of genocide. It is the aim of this complaint to have it thoroughly examined by the Norwegian National Contact Point (NCP) under the Specific Instance Procedure of the OECD Guidelines.

As the Norwegian government is the majority owner of Telenor, Norway has a particular obligation to investigate fairly and without bias Telenor’s connection to the killing in Alethankyaw. Many of the major humanitarian and human rights legal treaties that Norway is a signatory of, call on states to make sure that non-state actors adhere to the human rights obligations the treaties contain, including prohibitions on genocide and torture.

We, the Committee Seeking Justice for Alethankyaw, hope that Norway takes these obligations seriously.
